General Terms and Conditions of Sale applicable to consumers on the website www.zantyro.com as of 01/02/2025

These general terms and conditions of sale govern all sales made by our company Ecomalda S.à rl-S (hereinafter the "Company"), trading as Zantyro, registered under number B293480 (RCS Luxembourg), located at 93, Rue de Dangé St Romain, 8261 Mamer, Luxembourg, to consumers purchasing for their personal needs on our merchant site (the Customer).

Any specific requirement of the Client shall in no case be enforceable against the Company unless it has been previously accepted in writing by the Company.

Orders placed on the website are governed by the general terms and conditions of sale applicable on the date of the order.

When validating the order by ticking the box to accept the Terms and Conditions, the Customer expressly accepts these conditions.

1 – ORDERS

The Company's acceptance of the Customer's order is evidenced by the sending of an order confirmation email.

The Company reserves the right to refuse an order for a legitimate reason (out of stock, abnormality of the order, etc.).

ONLINE CUSTOMER SERVICE: You can track your order by contacting customer service at the following number: +33 1 89 48 08 85. Opening hours are generally Monday to Friday, 9:00 AM to 12:00 PM and 2:00 PM to 5:00 PM, however, access to this telephone service may not be guaranteed throughout these hours. Email contact at affanyousaf0786@gmail.com is preferred.

2 – CANCELLATION

Except for the exercise of the right of withdrawal (article 6), the order cannot be cancelled except with the prior written agreement of the Company.

In any event, no cancellation for any reason whatsoever will be accepted on an order that is in progress.

3 – PRICE

Prices are shown in euros, inclusive of all taxes (VAT), but excluding delivery charges, which remain the responsibility of the customer. Delivery charges are indicated when placing the order.

Products are invoiced based on the rates and VAT rate in effect at the time the order is validated.

The Company may offer, on a temporary basis, promotional offers, discounts, discount codes, or commercial benefits. These offers are valid under the conditions indicated on the Website and, where applicable, while supplies last.

When the Site displays a countdown timer associated with an offer or promotional price, this countdown timer indicates the period during which the displayed prices, discounts, or commercial conditions are guaranteed to the Customer. Upon expiry of the countdown timer, the current prices, discounts, or offers may be modified, extended, renewed, or terminated without giving rise to any claim, subject to compliance with applicable regulations.

The price applicable to the Customer is the one displayed and confirmed at the time of order validation. Any price difference between an already validated order and a subsequent promotion, discount, or offer will not be eligible for retroactive refunds.

Discount codes cannot be combined with each other or with other current offers, unless expressly stated otherwise on the Site.

4 – DELIVERIES

Deliveries are made to the address indicated on the order.

Maximum delivery time: Except in cases of force majeure, the maximum guaranteed delivery time is thirty (30) calendar days from the date of the order. Beyond this legal deadline, the customer may request cancellation of their order and a full refund.

Estimated Delivery Times (including shipping):

Approximately 14 working days on average.

Carriers: Shipping is handled by WANB, YUNEXPRESS or other express carriers for international deliveries, and for the last mile by Colissimo, Colis Privé, GOFO/CIRRO France, Mondial Relay, Cainiao or other local partners.

All transport risks are borne by the Customer from the moment the goods leave the warehouse. The Customer must check the condition of the package upon receipt.

5 – NON-CONFORMITY AND RETURNS OUTSIDE THE RIGHT OF WITHDRAWAL

In the event of a claim concerning the quality of the goods delivered or their non-conformity, the Company's liability is strictly limited to the obligation to replace or refund these goods.

Non-conforming or defective items upon receipt: The Customer must contact customer service at affanyousaf0786@gmail.com within 48 hours of receipt, providing clear photographs and videos. The Company will cover the return shipping costs or the cost of reshipping a replacement if the defect is confirmed.

General conditions for returns: Products must be in their original condition, free from any damage, and returned in their original packaging, including all intact labels.

Non-returnable items (Exceptions):

• Gift cards and digital products.

• Custom-made or personalized items.

• Any hygiene product whose seal or hygienic protective packaging is opened, except in the case of a defect.

6 – RIGHT OF WITHDRAWAL AND COMMERCIAL RETURNS

The consumer Client has a legal right of withdrawal of fourteen (14) days from the receipt of his order, without having to justify any reason.

As a commercial gesture, the Company extends the possibility of requesting a return up to thirty (30) calendar days from receipt of the order, subject to compliance with the return conditions set out in these Terms and Conditions and in the Refund Policy.

To exercise their right of withdrawal or request a commercial return, the Customer must notify their request by email to affanyousaf0786@gmail.com, before any reshipment of the product, indicating their order number.

7 - PAYMENT TERMS

The Company accepts payments by credit card (CB, Visa, Mastercard) and via Paypal, as well as Klarna, Bancontact, Amex, Shop Pay.

Online payment by credit card is processed through the Shopify Payments security system or other secure platforms.

The order is automatically cancelled if full payment is not received.

8 – GUARANTEES

The Company (Ecomalda S.à rl-S) guarantees the conformity of the products (legal guarantee of conformity) and hidden defects under the conditions provided for by Luxembourg legislation transposing the European directive.

9 - INTELLECTUAL PROPERTY

All elements reproduced on www.zantyro.com are protected by copyright and intellectual property rights. Any reproduction, in whole or in part, of the site is strictly prohibited without the prior written consent of the Company.

10 – PROTECTION OF PERSONAL DATA

The Company undertakes to process the personal data of Clients in accordance with the General Data Protection Regulation (GDPR) and applicable regulations on the protection of personal data.

Information relating to the processing of personal data carried out by the Company, the purposes pursued, the legal bases, the recipients, the retention periods, the rights of the persons concerned and the methods of exercising these rights are detailed in the Privacy Policy accessible on the Site.

The Client has, in particular, a right of access, rectification, erasure, limitation, objection and, where applicable, a right to data portability, which he can exercise by email to affanyousaf0786@gmail.com or by mail to the following address: Ecomalda S.à rl-S, 93, Rue de Dangé St Romain, 8261 Mamer, Luxembourg.

11 – REFUNDS

If the return is approved, the refund amount will be credited to the original payment method within a maximum of seven (7) business days after receipt and inspection of the returned item.

12 – APPLICABLE LAW AND DISPUTE RESOLUTION

These General Terms and Conditions are governed by Luxembourg law.

13 - EXTENDED PRODUCER RESPONSIBILITY (EPR)

In accordance with French regulations relating to Extended Producer Responsibility (EPR), in particular the AGEC law, the company Ecomalda S.à rl-S, trading as Zantyro, is registered under the Household Packaging and Graphic Papers sector.

14 - PRODUCT AVAILABILITY CLAUSE

In the event of an unforeseen stock shortage or delayed restocking, the Company undertakes to inform the Customer as soon as possible. This delay shall not constitute grounds for withdrawal or cancellation of the order as long as the legal 30-day withdrawal period has not expired.

15 - CONSUMER MEDIATION

In accordance with the applicable provisions for the out-of-court settlement of consumer disputes, the Customer is informed that in the event of a dispute relating to an order placed on the Site, he or she may resort free of charge to a consumer mediator, after having first sent a written complaint to the Company's customer service and in the absence of a satisfactory response or amicable resolution of the dispute.
